What Documents Are Required to File for Emergency Bankruptcy?

When time is short and you need to file fast, your emergency filing will consist of only a few of the required forms. These initial forms will relay the bare bones of your bankruptcy action.

This information will include:

  • Your petition which identifies you, what type of bankruptcy you are filing (Chapter 7 or 13), and other basic information
  • Your creditors’ names and contact information
  • Your credit counseling certificate or, if you have not completed the certificate, a waiver request
  • A formal statement of your social security identity number

You will also need to make arrangements to pay the filing fee. Once the above has been filed with the court, you will then have 14 days to follow up with additional information and requirements per the court. If you fail to do so, your case will be dismissed by the court.
