Worcester Emergency Bankruptcy Lawyer
What Is an Emergency Bankruptcy Filing?
An emergency filing is also called a "skeleton” bankruptcy because it provides the "bare bones" minimum information and paperwork to start the process.
The only truly required document is the bankruptcy petition, three pages that include your:
- Name
- Address
- And chapter of bankruptcy under which you are filing
File for Skeleton Bankruptcy to Seek an Automatic Stay
Under ordinary circumstances, the bankruptcy process takes time for petition composition, extensive financial information, cross-checking, and attention to detail in order to avoid a dismissal of your case. However, in some cases, you may need to file an emergency bankruptcy.
This may be necessary when facing:
- The foreclosure sale of your home
- Repossession of your car
- Eviction
- Garnishment of your wages
- Or sudden lawsuits
With an emergency filing, you will be seeking the protection of the court’s automatic stay that stops or delays the actions of your creditors.
What Documents Are Required to File for Emergency Bankruptcy?
A professionally prepared bankruptcy filing can be upwards of 50 pages of documents.
When time is short and you need to file fast, your emergency filing will consist of only a few of the required forms. These initial forms will relay the bare bones of your bankruptcy action.
This information will include:
- Your petition which identifies you, what type of bankruptcy you are filing (Chapter 7 or 13), and other basic information
- Your creditors’ names and contact information
- Your credit counseling certificate or, if you have not completed the certificate, a waiver request
- A formal statement of your social security identity number
You will also need to make arrangements to pay the filing fee. Once the above has been filed with the court, you will then have 14 days to follow up with additional information and requirements per the court. If you fail to do so, your case will be dismissed by the court.
